The mere use of this website implies the knowledge and acceptance of these Terms and Conditions. In some particular cases, such as entering into a charter agreement, we will also ask you to explicitly agree.

Electronic Communication By using this website or communicating with us by electronic means, you agree and acknowledge that we may communicate with you electronically on our website or by sending an email to you, and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement, including but not limited to the requirement that such communications should be in writing.

5.2 Charter Inquiries and Agreements

• Inquiry: Users may make an inquiry for a yacht charter through the Site. This inquiry is an expression of interest and not a binding offer.
• Charter Proposal: Following an inquiry, Yachting Icon Cyprus will provide a bespoke Charter Proposal detailing the vessel, crew, proposed itinerary, and a full quotation of the Charter Fee.
• Charter Agreement: To secure a booking, the Charterer must sign a formal Charter Agreement provided by Yachting Icon Cyprus. This agreement will outline all specific terms, conditions, payment schedules, and cancellation policies for the specific charter.

5.3 Yacht Sales Inquiries The Site may feature yachts for sale. Interested parties may submit an inquiry for more information or to arrange a viewing. The process of purchasing a yacht will be governed by a separate Memorandum of Agreement (MOA) and is subject to satisfactory vessel survey and sea trials.

5.4 Charterer Obligations The Charterer and their guests agree to comply with the instructions of the Captain and crew, adhere to all safety regulations, and treat the yacht and its crew with respect and care. The Charterer is responsible for the conduct of their entire party.

5.5 Security Deposit & Advanced Provisioning Allowance (APA)

• Security Deposit: A security deposit may be required under the terms of the Charter Agreement to cover any potential damages to the yacht.
• APA: Most charters operate under an Advanced Provisioning Allowance (APA). This is an advance payment made by the Charterer to cover variable expenses such as fuel, food, beverages, and port fees. The Captain will manage these funds and provide a full account at the end of the charter. Any unspent APA will be refunded to the Charterer.

5.6 User Reviews Clients who have completed a charter or transaction with us may be invited to leave a review or testimonial. Reviews must be respectful, factual, and relevant to the experience.

6. Obligations of the Parties 6.1 General User Obligations All Users of the Site and Service agree to comply with these Terms and Conditions and all applicable laws. Users must provide only truthful and accurate information and must act in good faith in all interactions with Yachting Icon Cyprus.

6.2 Obligations of Yachting Icon Cyprus

• Accurate Representation: We will ensure that all yachts and services are described on the Site as accurately as possible.
• Yacht Condition: We ensure that any yacht offered for charter is delivered in a fully operational and seaworthy condition, professionally crewed, and prepared for the Charterer’s use as stipulated in the Charter Agreement.
• Professional Service: We will provide all our services with the highest level of professionalism, discretion, and care.

6.3 Specific Obligations of the Charterer

• Timely Payments: The Charterer must make all payments (including deposit, balance, and APA) by the dates specified in the Charter Agreement.
• Verification of Party: The Charterer must provide a final list of all guests in their party prior to the charter start date.
• Responsible Use: The Charterer is responsible for ensuring that they and their guests do not engage in any illegal activities or behaviors that could endanger the yacht, crew, or other guests.

7. Cancellation of Bookings All cancellations must be made in writing. The terms and financial consequences of a cancellation by the Charterer are determined exclusively by the cancellation policy detailed in the signed Charter Agreement. Due to the nature of yacht bookings, these policies are typically strict. Should Yachting Icon Cyprus be forced to cancel a charter, the Charterer will be entitled to a full refund of all payments made, as governed by the Charter Agreement.

8. Payment Terms Payments for charters and other services are typically made via bank transfer. The standard payment schedule for a charter is as follows:

• First Installment: 50% of the total Charter Fee is due upon signing the Charter Agreement.
• Final Installment: The remaining 50% of the Charter Fee, plus the Advanced Provisioning Allowance (APA) and any applicable taxes, is due 30-60 days prior to the embarkation date, as specified in the Charter Agreement. All payments must be made in the currency specified in the agreement.

9. Availability of Service and Site Yachting Icon Cyprus will make reasonable efforts to ensure the Site is available at all times. However, we do not guarantee uninterrupted access and will not be liable for any loss or inconvenience incurred due to site unavailability or technical issues.

10. Liability Yachting Icon Cyprus acts as the service provider and a direct party to the Charter Agreement. Our liability in connection with any charter or other service shall be governed by the terms set forth in the specific agreement for that service. To the maximum extent permitted by law, our total liability for any claims arising from your use of the website will be limited. We are not liable for indirect or consequential damages.

11. Force Majeure Yachting Icon Cyprus shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond our reasonable control. Such causes include, but are not limited to: severe weather events, acts of God, war, government actions, pandemics, or other events that make the performance of the charter impossible or unsafe. The consequences of a Force Majeure event will be governed by the terms of the specific Charter Agreement.

All personal and transactional information you provide will be treated with the utmost discretion and will not be disclosed to any third party, except as required to perform our services (e.g., providing a guest list to the yacht’s Captain) or as required by law. 13. Suspension/Termination Yachting Icon Cyprus reserves the right to suspend or terminate a User’s account, or refuse service, at its sole discretion, without notice or liability, for any reason, including but not limited to:

• Any breach of these Terms and Conditions.
• A material breach of a signed Charter Agreement or other service contract.
• Engaging in any fraudulent, abusive, or illegal activity.
• Any activity that poses a security or reputational risk to Yachting Icon Cyprus, its staff, its assets, or its clients.

14. Third-Party Websites and Content Our website may include hyperlinks or other references to other party’s websites (e.g., partners, tourism boards). We do not monitor or review the content of other party’s websites which are linked to from this website. Products or services offered by other websites shall be subject to the applicable Terms and Conditions of those third parties. We will not be responsible for any privacy practices or content of these sites and bear no liability for any loss or damage arising from your use of them.

The booking of a yacht charter is such a service. Therefore, your right to cancel and receive a refund for a charter is governed exclusively and strictly by the cancellation terms detailed in your signed Charter Agreement, which supersedes any statutory cooling-off period.

18. User-Generated Content We may provide open communication tools on our website, such as blog comments or a section for client testimonials. You agree that any content you contribute will be lawful and will not infringe on any person’s legal rights. You grant Yachting Icon Cyprus a non-exclusive, perpetual, royalty-free license to use, publish, and distribute your content in connection with our business. We reserve the right to review and remove any content at our sole discretion.

Idea Submission Do not submit any ideas, inventions, works of authorship, or other information that can be considered your own intellectual property that you would like to present to us unless we have first signed an agreement regarding the intellectual property or a non-disclosure agreement.
